This document outlines the Terms and conditions for using this website and purchasing any products from us. Please take a moment to read through this section as it sets expectations and boundaries. We have put it in place to create professional and respectful working relationships so we know what is expected of each other.

When you visit this website, use our services, or purchase our products, you agree that you are over the age of 18 and willing to be bound by these Terms & Conditions. If you don’t agree, you should not continue to visit this website or purchase anything from us. If you are under 18, you may have a parent or guardian accept these Terms & Conditions on your behalf. 

All products and services advertised on this website are offered in compliance with the Australian Consumer Law.

These Terms & Conditions may be changed or modified from time to time. Please check back regularly to ensure you are aware of any changes. 

There may be additional, specific terms of purchases or services provided to you in relation to our consultations. If there is any inconsistency between this document and those specific terms of service, these Website Terms & Conditions are overruled to the extent of the inconsistency.

On this website and in our social media accounts, we provide health information and wellness related topics. We believe having access to information regarding health is essential to feel your best. We want you to feel empowered when it comes to your own health and wellness.

This context is provided solely for your education and benefit to help you understand your health on a greater level and make informed choices in regards to your health and wellbeing. We want you to live the life you deserve and feel well doing so. Health really is wealth. We want to cut through all the noise online regarding micro health trends and quick fixes because health is for life, and not a trend.

We conduct extensive research to provide content that we believe to be valuable and true, but we have no responsibility for the use that you make of that information.

Qualifications
Laura’s qualifications include a Bachelor of Health Science (Naturopathy) and APPI Reformer and Mat Pilates Instructor. She is an accredited member with ANTA.

Consumer Responsibility
Important information about how to care for your own wellbeing/get the most value out of working with us is set out below. If you have any questions or concerns, please email us at laura@kyndnaturopathy.com.au before proceeding with your purchase.

Specific Instructions
Naturopathy is all about educating and supporting you to reach optimal health. We encourage you to keep an open mind when we discuss your health, please ask questions to get the most out of your consultation. We encourage you to answer every question honestly as there is no judgement. If there is anything that makes you feel uncomfortable during your consultation, you do not have to answer. Please do not share your treatment plan with anyone as it has been specifically tailored to meet your health needs. Everyone is different and a one sized treatment approach will not be appropriate for someone else.Naturopathy does not offer quick fixes and depending on the nature of your condition and severity of your condition/symptoms, the time frame in which you would expect results will vary. We want to create real, long lasting results. If you are after a quick fix, we may be able to provide symptomatic relief, however, this may not be the place for you.

Risks
Due to individual sensitivities, adverse reactions may occur when taking herbal medicines and supplements. Your practitioner is well equipped to prevent these reactions from occurring, but it is not a guarantee. If you become pregnant, start or stop any medication, please inform your practitioner as this may impact your current treatment plan. Please ensure you follow the correct dosage instructions provided by your practitioner. If you experience any ill/minor effects, stop taking your prescribed herbal medicine or supplements, and inform your practitioner. It is in your hands to ensure you follow the instructions given to you.

If something feels like an emergency, please call 000 or visit a hospital. We don't provide crisis response and it may take time to see us.

Limitations
We are Naturopaths, meaning we are not medical or mental health professionals. It is not within our scope to diagnose you with a certain disease or condition. If any concerns arise that are outside of our scope, please seek advice from qualified professionals in these areas. 

You remain fully responsible for your health at all times. If you are working alongside doctors and other allied health professionals to support your health needs, please inform us as we are always happy to work collaboratively as part of your holistic health care team.

We will do everything we can to ensure you feel heard and provide you with the best evidence-based treatment plan. We may not have all the answers to your health concerns. We will do our absolute best to prioritise your wellbeing. If something is out of our scope that requires further investigation or treatment, you will be referred to ensure optimal care. This does not mean we necessarily will stop working together.

Professional advice
Our scope is not a substitute for medical advice or mental health support. If any concerns arise, we strongly recommend you seek advice from an appropriately qualified professional.

Please make sure to always double check your labels when you receive any products, herbs or supplements from us.

Indemnity 

Content Errors
We do not make any guarantees or warranties about the accuracy of any material displayed on this website, or the products, services, or programs offered through it, with the exception of any non excludable consumer guarantees and other consumer protection provisions set out in the Australian Consumer Law. We are human and errors creep in despite the best of intentions. If you see something that doesn’t seem right, please let us know.  

Loss or damage 
While we make all reasonable efforts to ensure that this website and our products, services or programs/courses meet with the highest standards of best practice, if something does go wrong that is not a direct result of our negligence, misrepresentation or deliberate fault, you agree that, to the fullest extent permitted by law. We will not be liable for any loss or damage arising out of or related to our website, any products or services purchased through it, or any material posted on it, irrespective of whether such damages were foreseeable, and regardless of the nature of the claim.  

Liability for Advice
You take full responsibility for your implementation of any suggestions that we may make while providing our services. You understand that our advice is limited to providing you with options for your consideration, and that you are solely responsible for any actions that you choose to take. Always consult your own values and vision, do your own research, and check with appropriately qualified professionals before making major decisions or significant changes. You agree to indemnify us against all consequences arising directly or indirectly from your choices. 

Cap on damages
You expressly agree that if this indemnity is unenforceable for any reason, our total cumulative liability for all causes of action of any kind (other than negligence or deliberate wrongdoing) shall not exceed the amount that you have paid to us.

Appointment Policies
Please provide at least 24 hours notice (during business hours, Monday to Friday) if you need to cancel or reschedule your appointment. Missed appointments or those cancelled within 24 hours will forfeit 100% of the consultation fee paid at the time of booking your appointment.

Payment Terms 
All prices on our website are in Australian dollars and are inclusive of GST where applicable. GST is exempt from Naturopathic consultations.

All  payments made through this website are processed using Stripe, therefore we do not have access to your account details. Any financial information you enter is stored under Stripe’s security policy:  https://stripe.com/docs/security/stripe

For consultations, 100% of payment is required at the time of booking to secure your appointment. We are unable to offer appointments unless payment is taken ahead of time when making your booking. 

If you are no show to your appointment, you will forfeit 100% of the consultation fee.We understand life happens, if you have any concerns regarding your prescription, or appointment please email laura@kyndnaturopathy.com.au 

Payment for any prescriptions sent by us must be received before we can make up/send out your products. If an invoice is overdue by 30 days, a collection fee will occur and we will take the necessary steps to collect payment owed to us. Please email us if you need to discuss this further. 

If you purchase a custom herbal cream, 100% of product price will be required during purchasing. Once we have received your payment, we will make up your custom cream and send it to you within 2-3 business days.

If the clinic is closed during the holidays or we are away, you will be notified of the cut off dates in which you can receive your products.

Refund Policy 
We do not offer a refund if you change your mind. You are encouraged to consider carefully whether a purchase is right for you before you make your payment.

Order Fulfilment Policy 
If a product you have purchased is out of stock, we will do our best to find you an alternative. Or we will wait until that product comes back in stock to fulfill your order. You will be notified if anything is out of stock. 

If you demand a replacement product we will do our best to find you one. However, we cannot guarantee this. 

If a product is faulty we will replace it for you. If your digital treatment plan won’t open please email us at laura@kyndnaturopathy.com.au so we can resolve this quickly for you.

Consumer Guarantees 
Kynd Naturopathy complies with the Australian Consumer Law with regard to consumer guarantees. You can find more about this here: https://www.accc.gov.au/consumers/buying-products-and-services

Limitations of Liability
We take our obligations under the Australian Consumer Law seriously and will do our best to address any issues that arise. However, even if there is a major problem, our liability is strictly limited to:
- Replacing the goods or providing services again; or
- If we are unable to do so within a reasonable time, refunding the full amount that you have paid to us

If you feel that there is any problem with our services/your purchase, please let us know within 24 hours (during business hours Mon-Fri), so we can address your concerns and try to find a mutually acceptable solution.

Delivery and Shipping
When booking your 1:1 consultation, you will receive a confirmation email from Cliniko with a link for your telehealth appointment. If you choose a face-to-face appointment you will be sent an email with the clinic’s location. Please reach out to us if anything is unclear so we can provide clarification. 

For dispensed products, products will be shipped express to the address you provide (Aus only) through AusPost. If a product becomes damaged during transit, we will replace it for you. All individual prescriptions are final, we are unable to refund you for a change of mind. Prices may vary due to the size of your order.If you are collecting your products or supplements from the clinic, please select the pick up option at checkout. If you are purchasing your prescription through an online portal ordering system, they will ship your order out to you. 

Intellectual Property 

Copyright and Trade Secrets
The content of this website and in all our courses, resources, eBooks is protected by copyright laws and treaties around the world, with all rights reserved. This means that you must not use, copy or make our work public without our permission. 

If you are participating in our courses, content may be printed or downloaded to a local hard disk strictly for your personal and non-commercial use. Course content contains our trade secrets that are offered exclusively to participants. It is an essential condition of participation that you agree that you will not provide extracts of any course content to anyone else under any circumstances/without explicit written consent. 

Commercial exploitation of our content in any way that competes with our business is strictly prohibited.

Dispute
 
If a dispute arises, you agree that you will not engage in any public discussion about  the issues, will behave politely towards us, and will avoid any conduct or  communication which might reasonably be expected to interfere with our business or personal interests. You agree to act in good faith and be reasonably cooperative at all stages of the dispute resolution process. We will treat you with the same consideration.

Negotiation
If you have any concerns, issues, or complaints, arising out of your use of this website, our products or services, or these terms and conditions, you agree to communicate with us with the intention of making a genuine effort to seek a win/win solution and trying to resolve the dispute in good faith through negotiation and discussion. Jurisdiction
These Website Terms & Conditions are subject to the governing law of Victoria. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of Victoria, and the Commonwealth of Australia, will have exclusive jurisdiction.
